City Council Approves SPA for MUD 113

Following the second of two public hearings, Sugar Land City Council approved a Strategic Partnership Agreement (SPA) with Fort Bend County Utility District No. 113, which includes Avalon and Brazos Landing.  Approval of the SPA is part of a process that could result in annexation by the end of the year.

Key elements of the agreement are:

·        Sugar Land will annex MUD 113 on or before Dec. 31, 2005, or the agreement terminates.

·        Property owners in MUD 113 will begin paying City taxes at the onset of the 2006 tax year.

·        The City will use $245,000 of district funds to pay for the City’s cost of providing fire protection services, streetlight reimbursements, repairs to infrastructure and water cost sharing to the two homeowners’ associations through Sept. 30, 2006.  The homeowners associations must contract directly with the City for these reimbursements beginning Oct. 1, 2006.

·        A pre-annexation inspection is required.

·        The district must levy a 2005 tax at a rate that falls between the City’s 2005 tax rate and the maximum allowed the District by law without public hearings.

·        MUD 113 must provide sufficient funds to pay for the district’s 2006 and 2007 debt service payments, which total approximately $2.2 million.

The SPA also includes items related to consultant contracts, payment of district obligations, traffic speed enforcement and dispute resolution.
