This is a request to permanently zone the area of proposed Telfair Section 10 and the site for the City of Sugar Land Fire Station No. 7, consisting of 29.943 acres, from Interim Standard Single-Family Residential (R-1) to Permanent Standard Single-Family Residential (R-1). The property is located north of New Territory Boulevard, south of Telfair Section 13, and east of Chatham Avenue and Telfair Sections 9 and 19. The Telfair property was annexed by the City under Ordinance No. 1431 on April 6, 2004 and was officially incorporated into the City on July 1, 2004. At that time Interim R-1 zoning was applied to the property. Plating for these sections of the Telfair development (10 and the future fire station site) is ongoing. The Preliminary Plat for Telfair Section was approved at last Planning and Zoning Commission meeting on October 13, 2009. The approved Preliminary Plat for Section 10 consisted of a total of 92 standard single-family lots. This request is in conformance with the Telfair General Plan - Proposed Amendment No. 4 which the Planning and Zoning Commission recommended approval to Council at the last meeting. This request is not in conflict with the City of Sugar Land Comprehensive Plan. This permanent zoning request, if approved by City Council, would require this property to comply with all R-1 (Standard Single-Family Residential) regulations as contained in Chapter 2 of the City of Sugar Land Development Code and bring the total R-1 acreage (developed for residential use) to 688.5 in Telfair. Additional information is attached. A Public Hearing was held at the October 22, 2009 Planning and Zoning Commission meeting. On November 16, 2004, City
Council adopted the revised Land Use Plan portion of the City’s Comprehensive
Plan under Ordinance No. 1468. The Land
Use Plan serves as a guide for recommendations of permanent zoning for annexed
properties and rezoning of existing properties within the City. The 28.19 acres of Section 10 were intended
for single-family residential development when the developer petitioned the
City for annexation. This proposed land
use is in accordance with the City’s Land Use Plan, and the Telfair General
Plan Proposed Amendment No. 4 (currently in process). Prior to the proposed amendment No. 4 to the
General Plan, this area was shown as single-family but was included in a
proposed Planned Development (PD) District area. The developer had planned to develop a type
of single-family residential which may have required the flexibility of
regulations through a PD district. The
developer has since decided to pursue a traditional single-family style similar
to the rest of the development and is therefore seeking a change to the General
Plan to reflect this Telfair Section 10 area to not be included in the PD
boundary. The proposed amendment to the
General Plan shows this area as standard single-family.
Also included in this
permanent zoning case is the property where the City will construct Fire
Station No. 7 at the northeast corner of New Territory Boulevard and Chatham
Avenue. The City currently owns 1.753
acres, purchased from Newland Communities in 2008. Similarly to the recently constructed Fire
Station No. 1 site, the City plans to
conduct a Public Information meeting related to design and schedule for
construction of the Fire Station No. 7 site in Telfair. At the time the meeting is scheduled, further
information will be provided.
Additional Information:
At the Public Hearing for this request, Commissioner Shaw asked a few
general questions about fire service to this area and about the schedule for
construction for the new fire station.
Currently, Fire Station No. 1 responds to all areas north of New
Territory Boulevard and Fire Station No. 5 responds to areas south of New
Territory Boulevard. The current
schedule for construction of the new Fire Station No. 7 in Telfair shows a 9-12
month construction schedule starting in April 2010.
