Due to the annexation of River Park on December 1, 2009, the Speed Regulations Ordinance is required to be revised to include State Highway 99. The portion of SH99 that will be incorporated into the City is from the intersection at US 59/SH99 north to the new city limits totaling a distance of 1.467 miles. Texas Department of Transportation (TxDOT) did a speed zone study along State Highway 99 from the intersection at US 59/SH99 north to the new city limits. The 2002 speed study was conducted in accordance with the Texas Department of Transportation Procedures For Establishing Speed Zones Manual. The maximum speed limits posted as the result of a study are based primarily on the 85th percentile speed. The speed zone study established the 85th percentile speed to be 60 miles per hour. Posting a roadway’s speed limit based on its 85th percentile speed is considered good and typical engineering practice. Currently, the posted speed limit from US59/SH99 to SH99/SH90a is 60 miles per hour. There are minimum access points through this section of SH 99. The Public Works Department recommends that the City Council approve the revisions to the existing Ordinance Section 5-128(a) and pass to second reading. |

AN ORDINANCE OF THE CITY OF SUGAR LAND, TEXAS, AMENDING
CHAPTER 5 (PUBLIC PROPERTY AND SERVICES) OF THE CODE OF ORDINANCES BY ADDING
SPEED ZONES FOR STATE HIGHWAY 99.
WHEREAS, on December 1, 2009, the City will annex that portion of State Highway 99 referenced in this ordinance; and
WHEREAS, the Texas Transportation Code authorizes the City Council to establish or alter the speed limits on city roadways based on the results of an engineering and traffic investigation; and
WHEREAS, based on the results of the State’s engineering and traffic investigation, the City Council desires to establish the speed limits on one or more roadways; NOW THEREFORE:
BE IT ORDAINED BY
THE CITY COUNCIL
OF THE CITY OF SUGAR LAND, TEXAS:
Section 1. That Section 5-128(a) is amended by adding a speed zone for State Highway 99 to read as follows:
U.S. Highway 99:
(1) From the centerline of where U.S. Highway 59 intersects State Highway 99 to the northern city limits, a distance of approximately 1.467 miles, 60 miles per hour.
Section 2. That any person found guilty of violating this ordinance will be fined not more than $200.00 for each offense. Notice of the enactment of this ordinance will be given by publishing the ordinance or its descriptive caption and penalty in the City's official newspaper one time within thirty days of passage.
Section 3. That this ordinance is effective on December 1, 2009.
