Recommended Action

Approve Resolution No. 09-30 nominating a candidate(s) to fill a vacancy for the remaining 2008/2009 term of office for the Fort Bend Central Appraisal District Board of Directors.

Executive Summary

On August 26, 2009, the City received notice that Tom Shirley, a board member of the Fort Bend Central Appraisal District Board of Directors, resigned.  Under Section 6.03 of the Property Tax Code, taxing entities have the responsibility to nominate a candidate to fill a vacancy for the remaining 2008/2009 term of office.  However the CAD Board of Directors has the responsibility of electing the candidate.  The deadline for submitting a nominee is October 9, 2009. 

 

Once the chief appraiser receives nominations from participating taxing entities, a list will be compiled and submitted to the board.  The CAD Board of Directors will elect, by majority vote of its members, one of the nominees to fill the remaining term.  The board will elect the new member at its regular meeting on October 19, 2009.

 

The eligibility requirements for serving as a board member of the CAD are:

 

Residency Requirements

Must be at least a two-year resident of the district just prior to swearing in.

Employment

Cannot be a taxing unit employee.

Contract Services

·         Cannot provide contracted services to the district or have a 10% interest in a business doing so.

·         Cannot provide contracted services involving property tax matters to a taxing unit or have a 10% interest in a business doing so.

Relative

Cannot be a relative within the second degree by blood or marriage of persons conducting business in the district as a paid property tax agent or a fee appraiser.

  • Lee Duggan III
  • Mary Gayle Brindley
  • Kevin Welsh
  • Wayne Poldrack

 

General board elections will be held in December.  At this time we have been notified that none of the existing board members have requested to be reappointed.  A resolution to nominate candidates to fill these five positions will be considered at the October 20 council meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS, NOMINATING ONE OR MORE CANDIDATES TO FILL A VACANCY ON THE FORT BEND COUNTY CENTRAL APPRAISAL DISTRICT BOARD OF DIRECTORS FOR THE REMAINING 2008 /2009 TERM OF OFFICE.

           

WHEREAS, the City Council is entitled to nominate one or more candidates to fill a vacancy on the Fort Bend County Central Appraisal District Board of Directors; and

 

            WHEREAS, the City Council has determined that it is in the best interest of the City to nominate one or more candidates to fill the vacancy; NOW, THEREFORE,

 

BE IT RESOLVED BY THE CITY COUNCIL

OF THE CITY OF SUGAR LAND, TEXAS:

 

Section 1.  That it nominates the following candidate or candidates to fill a vacancy on the Fort Bend County Central Appraisal District Board of Directors for the remaining 2008 - 2009 term of office:
