Recommended Action

Approve deductive change order in the amount of $89,435.00 with E.E. Reed Construction, L.P. to recognize the shared cost savings as part of the Houston Museum of Natural Science at Sugar Land project.

Executive Summary

As part of the City’s Capital Improvement Program, the City Council approved a contract with E.E. Reed Construction, L.P. on May 6, 2008, for the construction of the Houston Museum of Natural Science at Sugar Land project (MU0708).

This contract was procured through the competitive sealed proposal alternative delivery method.  As part of this method of procurement, the contract outlined the sharing of any potential cost savings accrued throughout the project:  60% of any savings would go to the City, and the remaining 40% would be kept by the contractor.

With the renovation project now fully complete, E.E. Reed Construction, L.P., has submitted their final billing and project cost accounting summary, which includes a total savings amount of $149,059.00.  Based on the cost sharing agreement, 60% - or $89,435.00 – is to be credited to the City of Sugar Land.

Staff is recommending that the City Council approve a deductive change order with E.E. Reed Construction, L.P., in the amount of $89,435.00 to recognize the City’s portion of the project savings.  Once approved by the City Council, these funds will go toward reimbursing Newland Communities for the City’s 53% share of the Telfair Central Access Road construction as outlined in the Agreement to Convey Property.  Additionally, with the approval of this change order, staff will officially close-out the contract with E.E. Construction, L.P., for the construction of building renovations as part of the Houston Museum of Natural Science at Sugar Land.
