Recommended Action

Approve First Reading of Ordinance 1724 suspending the imposition of certain permit fees for the repair or replacement of building roofs.

Executive Summary

On September 16th, 2008 the City Council adopted Ordinance No. 1708, waiving the permit fees for limited roof and siding repairs for structures damaged by Hurricane Ike.  At that time, the City anticipated that a large number of repair projects would be undertaken to remediate the light to moderate damage that our assessment teams identified across the City in the immediate aftermath of the storm.  However, given the age and condition of many of the roofs before the storm, as well as potential insurance benefits, most home owners are deciding to replace damaged roofs instead of opting for smaller scale repairs.  The current fee suspension ordinance does not allow permit fee waivers in these cases, and given that the large majority of permit seekers are opting for roof replacements, few citizens are receiving the benefits that Ordinance No. 1708 was intended to provide.  To remedy this situation, staff is proposing an ordinance that will waive permit fees for replacing roofs damaged by Hurricane Ike.

ORDINANCE NO. 1724

 

AN ORDINANCE OF THE CITY OF SUGAR LAND, TEXAS, SUSPENDING THE IMPOSITION OF CERTAIN PERMIT FEES FOR THE REPAIR OR REPLACEMENT OF ROOFS OF BUILDINGS. 

 

            WHEREAS, because of the damage resulting from Hurricane Ike, the City Council wishes to suspend the imposition of certain fees; NOW, THEREFORE;

 

BE IT ORDAINED BY THE CITY COUNCIL

OF THE CITY OF SUGAR LAND, TEXAS:

 

            Section 1.     That the imposition of existing permit fees applicable to the repair or replacement of a roof are suspended for any roof damaged by Hurricane Ike.   

 

            Section 2.  That the suspension of fees applies retroactively beginning at 7:00 a.m. on November 17, 2008, and will continue until the Council repeals this ordinance or the City Manager determines by written directive that the emergency requiring the suspension of the fees is no longer necessary.   

 

Section 3.  That this ordinance is effective upon first consideration, five or more members of the Council having voted to dispense with the requirement that this ordinance be considered on two separate days after determining an emergency exists because there is an immediate need to preserve and protect the peace, health, safety, or welfare of the community.
