Recommended Action

Receive presentation and hold workshop discussion; give direction regarding proposed Central Park at Riverstone General Plan amendment and concepts for proposed Riverstone Supplemental Development Agreement.

 

Executive Summary

 

 

This Workshop presentation is scheduled to allow the applicant and staff to present information regarding a proposed Riverstone General Plan amendment and Supplemental Development Agreement Concepts. 

 

The Riverstone developer has entered into a sales contract for two option tracts on the west side of the development.  The proposed buyer/developer proposes to change the land use and roadway layout from that portion of the current Riverstone General Plan.  The proposal also involves a Supplemental Development Agreement addressing specific regulatory issues.

 

As in a previous Riverstone Supplemental Development Agreement, the developer is proposing a mixed use development with private streets for single-family residential areas.  Again we are proposing a Development Agreement pursuant to the provisions of Sec. 212.172 Texas Local Government Code, allowing the City and ETJ Property Owner to enter into a Development Agreement authorizing land use and development regulations for the development of the property.  Staff and developer representatives are working together to assemble a Development Agreement that will authorize private streets in the project along with land use and development regulations to include:

 

  • Establish development densities, including:
    • Maximum number of residential units served by private streets
    • Minimum lot sizes
  • Identify Residential, Multifamily and Office/Commercial Areas
    • Establish density and dwelling unit maximums
    • Establish other Development Regulations Council determines necessary
  • Extend City landscaping, parking, sign and other regulations
  • Extend City Building Code, permit and inspection requirements

 

The proposed buyer/developer is working to complete a General Plan and Development Agreement before the due diligence period expires.  January 20, 2009 is the last available Council agenda before that period ends. 

 

In an effort to accommodate the buyer/developer’s timeframe, and in consideration of the staff review work on the recent Riverstone General Plan amendment, these items are on an accelerated schedule:

 

  • December 9, 2008 -  P&Z General Plan Workshop
  • December 16, 2008 -  City Council General Plan and Development Agreement Workshop
  • January 13, 2009 – P&Z Consideration and Action on General Plan
  • January 20, 2009 – City Council Consideration and Action on General Plan (pending P&Z action) and Supplemental Development Agreement Concepts.
