Executive Summary |
||||
|
The Police
Department has been using Community Assistance Support Team (CAST) volunteers
to enforce handicap parking violations since the summer of 2007. The program has allowed our volunteers to
write warning citations. We have found
the program to be effective. We would like for
our CAST members to be able to issue Municipal Violations. The Police Department and Legal Department have
researched state law and city ordinance. This can be accomplished by
amendments to Chapter 5, Section 51 of the Code of Ordinances to simplify the
existing provisions concerning traffic enforcement. The proposed amendments add a provision
that the Chief of Police can assign civilian employees or civilian volunteers
to issue municipal citations for parking violations. The Police
Department would recommend that our CAST volunteers be allowed to issue
Municipal Citations for parking violations.
We believe that this ability will further increase the effectiveness
of our citizen based handicap parking enforcement effort. |

CHAPTER 5 OF THE CODE OF ORDINANCES PROVIDING FOR CIVILIAN PARKING ENFORCEMENT
PERSONNEL TO ENFORCE TRAFFIC REGULATIONS.
BE IT ORDAINED BY
THE CITY COUNCIL
OF THE CITY OF SUGAR LAND, TEXAS:
Section 1. That Section 5-51 of the Code of Ordinances is amended to read as follows:
DIVISION 2. ENFORCEMENT AND
OBEDIENCE TO TRAFFIC REGULATIONS
Sec. 5-51. Parking enforcement personnel.
The Chief of Police may assign civilian volunteers and civilian employees as parking enforcement personnel. Parking enforcement personnel may enforce all traffic laws of the city and of the state relating to stopping, standing or parking by the issuance of a parking citation.
Section 2. That the provisions of this ordinance are severable and the invalidity of any part of this ordinance will not affect the validity of the remainder of the ordinance.
