Workshop Discussion and Overview of Pending Greatwood Limited Purpose Annexations.

Executive Summary

On April 22nd Council will consider and act on an ordinance for Limited Purpose annexation of property within Fort Bend County Municipal Utility Districts No. 106, 108, and 109 (Greatwood Community- Nonresidential properties).  This Limited Purpose Annexation is provided for through the Strategic Partnership Agreements (SPA) between Fort Bend County MUDs No. 106, 108, and 109 and the City of Sugar Land, as approved on November 6, 2007.

 

The purpose of this Workshop Discussion is to overview the Limited Purpose terms of the SPA and proposed provisions for the Limited Purpose Annexation Ordinance.

 

The SPA’s provide that we will:

 

·        Annex certain areas within Greatwood for Limited Purposes

o       Impose Sales and use Tax

o       Regulate the use of real property in the same extent regulated by ordinance within the full purpose boundaries of the City of Sugar Land

o       Place Sales and Use Tax revenues into the Greatwood Debt Reduction Fund.

 

Interim Zoning is established at the time of annexation.  The Development Code specifies that:

 

“Sec. 211(b)   All territory annexed to the City is temporarily classified as a R-1 district (Standard Single-Family Residential), unless the City Council designates a different temporary zoning classification in the annexation ordinance.”  We will bring forward an annexation ordinance with temporary classifications consistent with existing land uses.  This allows us to avoid creating non-conforming uses for existing developments.  This can be accomplished with standard zoning districts for most parcels.  For the golf course and country club, we will propose a basic PD ordinance, providing for the existing uses and development.
