Executive Summary

This ordinance implements the redistricting required by the annexation of Fort Bend County Municipal District  No. 113 in December 2005 by revising the boundary between Districts 3 and 4 so that 929 persons (and 667 voters) located in the Austin Park subdivision located in District 4 will be located in District 3. (See attached Redistricting Map).   The proposed plan will reduce the total maximum deviation of the Districts from 13% to 8.3%, well under the maximum of 10% allowed by law.  Under the proposed plan, the populations of the Districts before and after redistricting are as follows:

The ordinance also places the 1993 acres of the Telfair development annexed in 2004 into single member districts, by:

 

             (1)  Adding that portion of the annexed land lying south of U. S. Highway 59 to District No. 3;

 (2)  Adding  that portion of the annexed land lying north of U.S. Highway 59 to District No. 2; and

 (3)  Moving the strip of land lying south of U. S. Highway 90A, previously included in District No. 1, to   District No. 2 (see attached Annexation Map).

 

As a result of the redistricting and the annexation, the City’s current single member districts and boundaries will be as shown in the attached Current District Map.  

 

Following the adoption of the ordinance, we will submit the redistricting and annexation to the U.S. Department of Justice for approval as required by Federal law.  The county will adjust the county voting precincts to comply with the City’s changes after the November elections.

ORDINANCE NO. 1590

 

AN ORDINANCE OF THE CITY OF SUGAR LAND, TEXAS, ADOPTING CHANGES TO THE CITY’S SINGLE MEMBER DISTRICT BOUNDARIES; ADDING LAND ANNEXED BY ORDINANCE NO. 1431 TO THE SINGLE MEMBER DISTRICTS; AMENDING SECTION 2-3 OF THE CODE OF ORDINANCES RELATING TO THE DISTRICT BOUNDARIES; AND REPEALING ORDINANCE NO. 1376.    

 

WHEREAS, Article II, Section 2.01 of the Charter of the City of Sugar Land, Texas, provides that four council members will be elected from districts; and

 

WHEREAS, on December 2005, the City Council added 1101 persons to single member district no. 4 when it annexed Fort Bend County Municipal Utility District No. 113, (Avalon and Brazos Landing); and

 

WHEREAS, to comply with the legal requirement that the districts have substantially equal populations, the City Council wishes to revise the district boundary between Districts 3 and 4 so that 929 persons (and 667 voters) located in the Austin Park subdivision, now located in District 4, would be located in District 3; and 

 

WHEREAS, on August 15 and September 5, 2006, the City Council held public hearings to receive comments on City Council’s redistricting plan or alternative plans, notice of which was given by newspaper publication prior to the hearing date; and

 

WHEREAS, on April 6, 2004, by approval of Ordinance No. 1431, the City Council annexed approximately 1993 acres of land, (known as the Telfair development), into the City limits; and

 

WHEREAS, the Council wishes to: 

 

(1) Add that portion of the annexed land lying south of U. S. Highway 59 to District No. 3;

(2) Add that portion of the annexed land lying north of U.S. Highway 59 and south of U.S. Highway 90A to District No. 2; and

(3) Move the strip of land lying south of U. S. Highway 90A, previously included in District No. 1 under a prior annexation, to District No. 2;  NOW, THEREFORE;

 

BE IT ORDAINED BY THE CITY COUNCIL

OF THE CITY OF SUGAR LAND, TEXAS:

 

Section 1.  That Ordinance No. 1376, adopted on October 15, 2002, adopting changes to the City’s single member districts is repealed.  

 

Section 2.  That the boundaries of the City’s four single-member districts are amended to follow the boundaries as shown on the map attached to this ordinance as Exhibit A, and to include the census blocks for each district as described in Exhibit B, both of which are incorporated into this ordinance by reference.

 

            Section 2.  That Section 2-9 of the City of Sugar Land’s Code of Ordinances is amended to read as follows:    

 

            Sec. 2-3.  Council district boundaries.

 

                  (a) The current boundaries of the four single-member council districts are as established by Ordinance No. 1590, approved by the city council on November 7, 2006. A copy of the ordinance and descriptions of the districts as contained in Exhibits A and B of the ordinance are on file with the City Secretary and available for public inspection.
